Terms of Service

These Terms govern your use of The Memory Bar (the "Service"), a web application operated by Laurence Fuller ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms.
1. The Service
The Memory Bar is a personal mnemonic tool for bartenders and cocktail enthusiasts. It lets you build a private symbol library, generate memory scenes for cocktail specs, and train recall through drills.
2. Eligibility & account
You must be of legal age in your jurisdiction to enter into a contract. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
3. Acceptable use
You agree not to misuse the Service, including: using it unlawfully, for fraud or spam, infringing intellectual-property rights, uploading malware, scraping, probing or interfering with security, attempting to reverse-engineer the Service, reselling or redistributing access, or circumventing technical limits or plan quotas.
4. AI-generated content
The Service uses AI models to generate memory scenes and images from the inputs you provide. You are responsible for your prompts, for verifying outputs, and for having the rights to any content you input. Outputs may be inaccurate and are not a substitute for professional advice. We may filter or refuse to generate content that violates these Terms or applicable law, and we may suspend accounts for repeated infringement or abuse.
5. Intellectual property
The Service, its software, branding and documentation are owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain rights to the personal content you put into your library; you grant us a limited licence to host and process it solely to provide the Service to you.
6. Payments, subscriptions & merchant of record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals and cancellations are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled. You may cancel at any time via the in-app "Manage" link, which opens Paddle's customer portal; paid access continues through the end of your current billing period.

8. Service availability & warranties
We do not guarantee that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties (including merchantability and fitness for a particular purpose).
9. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill). Nothing in these Terms limits liability for fraud, death or personal injury where law prohibits limitation.
10. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
11. Suspension & termination
We may suspend or terminate access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete your account data after a reasonable export window.
12. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Laurence Fuller resides, without regard to conflict-of-law rules.
